Hereinafter referred to as "MADAME T" or "Seller".
2. Scope of Application
These General Terms and Conditions of Sale ("GTC") govern distance purchase contracts concluded between MADAME T and consumers ("Customer") through the website www.madamet.it ("Site").
A "consumer" is a natural person acting for purposes outside their trade, business, craft or profession (Art. 3(1)(a) of Legislative Decree 206/2005 — Consumer Code).
Contracts between MADAME T and business customers (B2B) fall outside the scope of the Consumer Code and are governed by these GTC to the extent compatible, and otherwise by the Italian Civil Code.
These GTC are made available to the Customer before the contract is concluded so that they may read, store and reproduce them in accordance with Art. 12 of Legislative Decree 70/2003.
MADAME T reserves the right to amend these GTC at any time. Amendments apply to orders placed after the updated version is published.
3. Products
MADAME T sells beachwear and swimwear of its own production.
The essential characteristics of each product (description, materials, composition, available sizes) are detailed on the relevant product page on the Site. Images are for illustrative purposes only; MADAME T endeavours to ensure the greatest possible colour accuracy, subject to variation depending on the Customer's monitor.
MADAME T reserves the right to change the available assortment at any time without notice.
4. Prices
Prices on the Site are in Euros (€) and include applicable VAT, unless otherwise stated.
Shipping costs are not included in the product price and are shown separately before the order is completed.
MADAME T reserves the right to change prices at any time. The price applicable to an order is the one shown at the time the Customer confirms the order.
Offers and promotions. In accordance with the Omnibus Directive (Legislative Decree 26/2023), where a discounted price is applied, MADAME T indicates the lowest price charged in the 30 days prior to the reduction. Where progressive reductions apply, the reference price is the lowest price applied in the 30 days before the promotion started.
5. Order Process
5.1 Adding to cart
The Customer selects the desired products and adds them to the cart. Adding items to the cart does not constitute a contractual commitment.
5.2 Order summary
Before proceeding to payment, the Customer views the order summary containing: list of products, quantities, unit and total prices, VAT, shipping costs, delivery address and payment method.
5.3 Confirmation and payment
The contract is concluded when the Customer completes payment. MADAME T sends the Customer an order confirmation email to the address provided at purchase, containing the order summary and an order reference number.
5.4 Order acceptance
MADAME T reserves the right to decline or cancel an order in the event of: product unavailability, errors in data entered by the Customer, inability to verify payment, or suspected fraudulent use. In such cases, MADAME T will notify the Customer promptly and issue a refund of any amounts paid.
6. Payment Methods
The Customer may pay by the following methods:
- Credit / debit card: Visa, Mastercard, American Express (secure transaction via Shopify Payments)
- PayPal: payment via PayPal account or card through PayPal
- Scalapay: instalment payment in 3 interest-free instalments (subject to terms and approval by Scalapay Italy S.r.l.)
- Klarna: instalment or deferred payment (subject to terms and approval by Klarna Bank AB)
Payment is charged at the time of order confirmation. For instalment payments via Scalapay or Klarna, the terms and conditions of the respective providers apply; they act as independent creditors with respect to the Customer.
MADAME T does not collect or store the Customer's payment card details; such data passes exclusively through the secure systems of the payment providers.
7. Shipping and Delivery
7.1 Courier and times
Shipments are made by express courier. Estimated delivery times are 3 to 5 business days from payment confirmation, subject to delays attributable to the courier or force majeure.
7.2 Shipping area
MADAME T ships within Italy and, where indicated on the Site, to other countries. Shipments to non-EU countries may be subject to customs duties and local taxes payable by the recipient.
7.3 Shipping costs
Shipping costs are shown at checkout. Any free shipping thresholds are communicated on the Site.
7.4 Inspection on receipt
The Customer is invited to check the integrity of the packaging upon delivery. In the event of visible damage, the Customer must sign with reservation and contact MADAME T within 48 hours of delivery.
7.5 Failed delivery
If the recipient is absent, the courier will leave a notice and attempt a second delivery or deposit the parcel at a pickup point. If the parcel is not collected within the courier's deadline, it returns to MADAME T and re-shipping costs are payable by the Customer.
8. Right of Withdrawal
8.1 Consumer right of withdrawal
In accordance with Arts. 52 et seq. of the Consumer Code (Legislative Decree 206/2005, as amended by Legislative Decree 21/2014), the consumer Customer has the right to withdraw from the contract without giving any reason within 14 days from the date on which the Customer, or a third party designated by them (other than the carrier), takes physical possession of the goods.
8.2 How to exercise withdrawal
To exercise the right of withdrawal, the Customer must notify MADAME T of their decision by means of an unequivocal statement (for example by email to info@madamet.it) before the deadline expires. The Customer may use the standard withdrawal form set out in Annex I, Part B of Legislative Decree 21/2014 (reproduced in the Appendix to these GTC), but is not obliged to do so.
8.3 Effects of withdrawal — Refund
Where withdrawal is valid, MADAME T will reimburse all payments received from the Customer, including standard delivery costs (excluding any additional costs arising from the Customer's choice of a non-standard delivery type), without undue delay and in any event within 14 days of the date on which MADAME T is informed of the decision to withdraw.
The refund is made using the same payment method as the original purchase, unless the Customer expressly agrees otherwise. The refund may be withheld until the returned goods are received or until the Customer provides proof of shipment.
8.4 Return of products
The Customer must return the products without undue delay and in any event within 14 days of communicating withdrawal. The direct costs of return are payable by the Customer.
Products must be returned in their original condition, with labels intact, sealed in the original hygienic packaging and showing no signs of use. MADAME T reserves the right to deduct from the refund an amount corresponding to any diminution in value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
8.5 Exclusions from right of withdrawal
Pursuant to Art. 59(1)(e) of the Consumer Code, the right of withdrawal is excluded for sealed goods which are not suitable for return for reasons of health protection or hygiene and which have been unsealed after delivery.
MADAME T's swimwear and beachwear are supplied with a protective hygiene seal (lingerie liner / adhesive hygiene strip in the gusset area). Once the hygiene seal is removed or found to be altered, the product cannot be returned under current regulations.
The Customer is therefore invited to:
- try the item only with the seal intact;
- wear underwear during the try-on;
- check size and colorway before removing the seal.
9. Legal Guarantee
In accordance with Arts. 128 to 135 of the Consumer Code (as amended by Legislative Decree 170/2021 implementing EU Directive 2019/771), MADAME T is liable for any lack of conformity existing at the time of delivery and which becomes apparent within two years of delivery.
A lack of conformity that becomes apparent within one year of delivery is presumed to have existed at the time of delivery, unless proven otherwise by the Seller.
In the event of a lack of conformity, the Customer is entitled, at their choice, to restoration of conformity (repair or replacement) or, where this is not possible or not proportionate, to a proportionate reduction of the price or termination of the contract.
To invoke the legal guarantee, the Customer must contact MADAME T at info@madamet.it, stating the order number and describing the defect, attaching photographic evidence where possible.
The legal guarantee does not cover damage resulting from improper use, negligence, exposure to chemical agents (sunscreen, chlorine, salt water beyond normal use), washing contrary to the care instructions on the label, or normal wear and tear.
10. Liability
MADAME T is not liable for delays or failures caused by force majeure events, including but not limited to: natural disasters, pandemics, strikes, network service outages, acts of public authorities.
MADAME T is not liable for indirect or consequential damages or loss of profit arising from the use of purchased products, to the extent permitted by applicable law.
11. Dispute Resolution
11.1 Amicable resolution
Before taking legal action, the Customer is invited to contact MADAME T at info@madamet.it to attempt an amicable resolution.
11.2 Alternative dispute resolution (ADR/ODR)
In accordance with Legislative Decree 130/2015 and EU Regulation 524/2013, the Customer may have recourse to alternative dispute resolution (ADR) procedures. The European Commission makes available an online dispute resolution (ODR) platform accessible at: https://ec.europa.eu/consumers/odr
MADAME T is not obliged to use ADR procedures and is not registered with any specific ADR body, unless otherwise communicated.
11.3 Jurisdiction
For consumer Customers, the court of the consumer's place of residence or elected domicile has jurisdiction, pursuant to Art. 66-bis of the Consumer Code.
For business customers (B2B), the exclusive jurisdiction is the Court of Bergamo.
12. Applicable Law
These GTC are governed by Italian law. Matters not expressly covered are subject to the Italian Civil Code and the Consumer Code (Legislative Decree 206/2005 and subsequent amendments).
13. Privacy
The processing of the Customer's personal data is governed by the Privacy Policy available on the Site, drawn up in accordance with EU Regulation 2016/679 (GDPR).
14. Intellectual Property
All content on the Site (texts, images, logos, design, graphics) is owned by or licensed to MADAME T and is protected by applicable copyright and intellectual property law. Any unauthorised reproduction, distribution or use is prohibited.
